I was arrested for DUI

First of all you should always carry a brand new bottle of hard liquor in your car with you.

If you are ever pulled over and you are in danger of getting a DUI, here's what you should do.

-Turn off the engine, take the keys out of the ignition and throw them out the window.

-Carefully step out of the vehicle.

-Open up the bottle of alcohol and start chugging it in front of the cop.

At that point any test the officer performs on you will show that you are drunk, but you can claim that you just now got drunk and that you hadn't been during the time of your driving and there is no way that they can prove otherwise since a breathalyser will show off the charts and by the time they perform a blood test your alcohol level will have been effected by what you just drank.

Since you are not behind the wheel of the vehicle and you don't have your keys, they can't arrest you for drunk driving, or for driving with an open alcohol container.

They might be able to cite you for public intoxication, but it is far less severe than DUI.

This is wholly incorrect.

There are many BAC tests that can be run that measure your actual consumption from 30 minutes to several hours before, ones that actually test how "affected" you really are! Several of these are now available in portable units, as well as the fact that they can test you at the station in a short period of time that would show your actual driving condition unaffected or little affected by any more recent "chugging" attempt.

Besides, do you think the cop is going to let you drive off after watching you chug? In all honesty, far, far more often than not, the cop is going to care about your safety, as well as the others, and detain you to prevent you from driving off. Call them assholes or bitches for doing so, but they seen stupid people who die every day, and really hate seeing the possibility of another.
 
I'd like to see how well that stood up in court. There is no test other than a FST that can tell how effected you are by alcohol, since there are a myriad of factors that can alter it. And even if it could, the law is not based on how effected you are, it's based on what your blood alcohol level is.

Obviously you made this up thinking you're clever, or you did it for just a joke. But this will not work for several reasons. First, if you get out of the car like you say you will be ordered to get back in the car, or have a jumpy cop pull a gun or tazer on you, not knowing your intention. Second, even if that didn't happen, you would get arrested for being drunk in public. And if all that worked, I still think there would be a good chance at him arresting you anyway and having the case go to court.

You should look up the law in your state. I read that In Washington they ruled that it is unlawful.

So what? Cops can't attack you just for the hell of it, or for not cooperating with them if you do so in a manner that is not threatening. If they did you could sue the police department for excessive force and battery, and you'd probably get away with it. In any case at least you could expect your DUI charges to get thrown out.

It was just one of those situations where you think your cool to drive and it finally bit me in the ass.

Yea I know exactly that point. You know your probably to drunk to be driving, by legal standards, yet you still "feel" like your in control of your self. I've been there and driven home a few times. I hate doing it though. Cause like you it will no doubt bite me in the ass some day...

Well my DWI story I beleive has been told here before. Rolled my car (totalled it at a Blue Book value of $3000), hit a light pole (got a bill in the mail from the Gov't for $4000), paid $1000 to get my liscence back, bought a new car for $3000, and had to do classes and a bunch of other stuff. I figure I lost at least $10K that night.

I've met people who have had their $30K vehicles seized by the government...and I know other guys who have mutlipled with hard time hanging over their heads if they get caught again. The moral of the story: drinking and driving in America today is SERIOUS business. I would advise anyone who is a serial drinker/driver like I used to be to count your blessings, because they don't F around anymore.

It's not like 30 years ago when they would drive you home and let you sleep it off; it is now big business for the government - lots of $$$ to be made for Uncle Sam by seizing vehicles, forced treatment, a myriad of fines, in addition to everything else they throw at you now. Come on..they have a MASSIVE deficit which they need to address by legally robbing everyone they can.

Bingo! It's a profit enterprise nowadays.

In some places the local and state governments charge to you the costs for each cop on the scene..(never mind the fact that they're on duty anyway and you have no say in them calling in some cases 4 or more patrol cars to the scene)...they then funnel you to these thought reform classes which make the problem worse as they are there to treat you like you suffer from alcohol addiction and take a zero tolerance approach. If you are an alcoholic why would treating you like a recreational drinker benefit you?? It wouldn't no more than treating a recreational drinker like an alcoholic will benefit them. If a message doesn't resonate or apply to a listener...it will be tuned out...that's simple human nature. Then the insurance companies get to pick at your bones and the state who makes you pay an exorbitant fee (tax) to get your license back.

So much money is in DUI's, it's likely the case the last thing local and state officials want is for people to not drink and drive.

Again, don't get me wrong. I don't condone any degree of irresponsibility while driving (of which there are many types) which jeopardizes the lives of others and people under the influence have caused irreparable harm to the lives of others. But why don't the states pay more attention to helping people be more responsible drinkers and tip them on how to not drive while impaired? As opposed to trying to scare a recreational drinker straight.

Yeah. He might want to make sure he has a chase vehicle with him that's equipped with a video camera (night vision might help too). Still, his suggestion was one of the funniest things I've read since being here. I had to get up and walk outside I was laughing so hard.
