Since you are not behind the wheel of the vehicle and you don't have your keys, they can't arrest you for drunk driving, or for driving with an open alcohol container.
They might be able to cite you for public intoxication, but it is far less severe than DUI.

First, if you get out of the car like you say you will be ordered to get back in the car, or have a jumpy cop pull a gun or tazer on you, not knowing your intention.

There are many BAC tests that can be run that measure your actual consumption from 30 minutes to several hours before, ones that actually test how "affected" you really are! Several of these are now available in portable units, as well as the fact that they can test you at the station in a short period of time that would show your actual driving condition unaffected or little affected by any more recent "chugging" attempt.
Nice try, but a very false hope.
Besides, do you think the cop is going to let you drive off after watching you chug? In all honesty, far, far more often than not, the cop is going to care about your safety, as well as the others, and detain you to prevent you from driving off. Call them assholes or bitches for doing so, but they seen stupid people who die every day, and really hate seeing the possibility of another.
Also I don't see how they can take your blood without your consent or without a warrant under search and seizure statutes.
You should look up the law in your state. I read that In Washington they ruled that it is unlawful.

It was just one of those situations where you think your cool to drive and it finally bit me in the ass.
it is now big business for the government - lots of $$$ to be made for Uncle Sam by seizing vehicles, forced treatment, a myriad of fines, in addition to everything else they throw at you now. Come on..they have a MASSIVE deficit which they need to address by legally robbing everyone they can.
So what? Cops can't attack you just for the hell of it, or for not cooperating with them if you do so in a manner that is not threatening. If they did you could sue the police department for excessive force and battery, and you'd probably get away with it. .
