I know what you meant. Technically they have already been passing judgement on thought crimes. It is usually the difference between 1st degree murder and all the others. First degree is premeditated, which means you had a chance to think it over and you still chose to follow through. Personally I have no issue with the charge of hate crime being tacked on. Its just a little extra icing on the cake to go with the already massive first degree charge the kid is looking at, which is the bulk of the time he would be doing anyway. If there ever was a way for them to send people to jail for just thinking about a crime and not following through, then we would have a serious problem.

Funny thing is I thought someone might mention this as someone had done in one of my previous threads with a similar title. I guess it's more of an English term, 'shot dead' is often used over here when describing someone who is shot and killed. I guess the US alternative is 'fatally shot' :dunno:

You are correct, 'fatally shot' is what we'd use. Typically, 'shot dead' is only used at the end of a sentence, so as to avoid confusion in the middle of a sentence.

This whole story has been written to make the kid who killed him as despicable as possible. The truth is that BOTH of these boys were unstable and the school system did nothing to control their behavior.

I think Hate Crimes are enhancements the same way acts of terrorism get treated differntly. Hate crimes are seen as especially transgressive against society because they disrupt community cohesion.

I just wish hate crimes were EVENLY applied. There are so many cases that should be considered hate crimes where the prosecution has not because the accused has the wrong skin color.

It is there in place to service the criminal most of the time and the victims are the ones made feel like they have done something wrong. Just sad. Stuff like this, bullying, peer pressure. It isn't easy growing up and I don't think it is getting easier. (Although I guess less people are dying of diseases then they used to, but I digress...)

Actually you'll find that McInerney along with other pupils had been bullying and harassing King for some time because he was gay, at some point King decided enough was enough and started giving back as good as he good. He made one flirtatious comment to McInerney in a crowded hallway which left McInerney embarassed and angry and he decided he would kill King, other pupils are already testifying to this. The simple truth is McInerney liked being the bully but when his victim started giving back as good as he got he couldn't handle it, he planned on murdering the kid and then went through with it and that's it. You complain the teachers did nothing over the one comment that King made to McInerney but what about the many made by McInerney to King which started all of this, is the bullying of King less important because he was gay?
