I was arrested for DUI

Worst night of my life:

Last week I was out on the town with a friend having a good time. We had a good amount of drinks, mostly beer and a few mixed drinks. It was just one of those situations where you think your cool to drive and it finally bit me in the ass.

Cop pulled me over and said I was swerving in between lanes, which I was not. I wasn't driving reckless at all, I was doing 65mph the whole time in the slow lane. Then he made me do the typical bogus tests and then blow twice in the breathalyzer, and he never told me what I blew. Got handcuffed, put in the back of the cop car, and taken down to the police station. Inside, this weird looking lady took a blood sample from my arm with a needle. Then I got booked and spent 9 hours in the drunk tank and it was the longest 9 hours of my life. Finally by the end, I was released and immediately got my car out of the impound. Thing is, they never told me how drunk I was so I'm meeting with a lawyer this week.

Why the worst night of my life? Being arrested, having my car towed, experiencing jail, having my family look down on me, what I'm about to face in court, and what I could have done - I could have killed myself or someone else. This is just my 1st offense so I guess I have some slack, but I have defiantly learned my lesson. I'm telling you right here, drinking and driving is not worth the risk!

Just wanted to share with you all and maybe get advice from anyone who has gone through this nightmare.

if you're drunk you can't tell if you are weaving or not. a cop's not gonna pull you over for suspected DUI and put you through tests and then arrest you for it if you're not too drunk to drive. even if you're right at .08, you're too drunk to drive.
 
A few things here:

01.) Don't post about this pending legal action on a forum where everyone can read it....it just might be used against you.

02.) Not knowing what state you were in at the time of the arrest makes it hard to comment on the police procedures....they vary, along with laws from state to state

03.) By your own admission you were drinking and got behind the wheel of a car & drove....you roll the dice everytime that you do that.

04.) There are two sides to every story and I'm sure the cop's version with differ from yours.

05.) Do you have any previous DUI arrests in your past?

The possibility of killing yourself isn't the biggest mistake you made. After all, you and no one else made the decision to drive while under the influence of alcohol. The biggest mistake you made is also knowingly endangering other road users.

I'm glad you learned something from the experience but you deserve everything that's coming to you.
 
First of all, in most states the Dept. of Motor Veh. will suspend your license within 10 days if you don't call to request a stay pending a hearing with them. Normally the cops will issue you a form that suggests you use it in place of your license for 30 days. That means nothing as if you don't request a stay your license will be suspended by the DMV no matter what that paper says within 10 days.

Next thing is this, you were most likely over the legal limit just based on the nature of the drinking you claimed to have engaged in.

If you blew into a breathalyzer...hard to believe you didn't leave their knowing what your BAC was (blood or urine test I could see as the results need to be analyzed elsewhere)....it most certainly would be on the citation you were issued (if any..can't remember if you said you were cited). If you weren't cited...you did nothing wrong and you were somehow under the legal limit.

For your money since the cop most likely has you nailed on probable cause when he stopped you...(i.e. you admitted to drinking, performed a Field "sobriety" test..and failed of course, or you blew into a portable breathalyzer used to establish the presence of alchohol)..save your money. Take a deal from the prosecutor at arraignment, do the thought reform classes and your temp suspension and try not to drink and drive again.:2 cents:

i know not to D & D it's only idiots who think they are unbreakable that get behind the wheel.
now i am calling you an idiot, but, i like that you are on the fast track to a lesson learned. good for you.

but to anyone else who either reads this and still D & D's or to anyone who doesn't read this and D & D's .... i hope your next drive ends in a crash killing a family of 4....cause then even though it's too late ... you may learn your lesson!

Do you feel the same way about people who speed, blow through stop signs and/or drive otherwise inattentively?

More accidents are caused by people who haven't been drinking and driving than have. Because of sensationalize stories, drinking and driving garners the most attention but the overwhelming majority of people who drink and drive never cause accidents. I'm not defending it...just stating the facts.:2 cents:

I'm willing to bet that they did tell you what your BAC was; you probably just don't remember. When I was arrested for my DUI, they told me what my BAC was as soon as I blew into the breathalyzer.

I got my DUI a few years back and, since I've been through all of the fun, I'll offer my advice...

If your BAC was over the legal limit, plead "NO CONTEST". Depending on what the particular laws are in your state, you'll probably lose your license for anywhere between 6 months and 1 year, get 40 or so hours of community service, be forced to attend a few MADD meetings, AA meetings or a weekend retreat in which you will be forced to take alcohol-related classes for a few days. Also, you'll get a pretty hefty fine.

It sucks, but unless your lawyer can find some sort of loophole that can prove your innocence or render the blood test inadmissable in court, you're going to be convicted. So, your best bet is to just suck it up and deal with it.

i want to say no. i drive aggressively. but aggressively DEFENSIVE which my dad taught me to do. always think one step ahead of everything going on around you. so i won't say i don't speed. but i do my best to speed up to clear spots on a highway that i feel there are idiots on the phone,busy singing or not paying attention in general.i have gotten up to 90 or 100 to get past some dopes on the road. i don't have a heavy foot on rural streets.
i would love and wouldn't mind seeing some sope on a cell phone rear end someone cause they weren't paying attention. i guess im just a nasty fuck who wants people to get hurt? :wave:

It sucks, but you'll get through it... just learn from it and don't do it again. I had it hapen to me about 15 years ago, not if I have more than 1 beer, I cab!

here's a fact, take it for what is worth (which may not be much as it applies only to me, but it's the truth): driving the last 30 years, i have caused 0 accidents, have 0 traffic tickets and never even been pulled over by a cop. and i drink and drive all the time. i never speed, always drive defensively, stay in my lane and obey all traffic laws (except the DUI one). i have avoided countless accidents due to 1) superior reflexes and 2) anticipatory thinking (eg. i always assume someone will pull in front of me, or swerve into my lane and i'm ready). i'm not saying you should do that, and you may say i've been damn lucky, but the bottom line is i'm a bettter driver even after several drinks than most people are stone sober. so there :wave2:

p.s. i've also driven on the LA freeways while tripping on LSD but i DO NOT RECOMMEND THAT and I will not do that again and admit i was dang lucky.
 
Irresponsibility is irresponsibility ...

In reality, irresponsibility is irresponsibility ... whether it's while you're driving or before you drive. People are irresponsible and must account for their actions. The message on Drinking'n Driving continues to be focused on because people fail to think, and then end up driving on the road like they never would had they been sober.

Because people don't think. They don't realize they are not in a state where they should be driving anything. Because they just don't realize their irresponsibility until it's too late. Because it's not obvious like when they actually choose to be irresponsible. And especially because of the demographics.

Failure to yield right of way is the biggest accident cause in adolescents and the elderly. But for responsible drivers, especially ages 25-44, it's many stupid things, including not realizing you've had too much.

Uh believe it or not, Cops will pull you over for bogus shit just to see if you are driving drunk. ANd when they find out your not drunk, they will let you go without a ticket.
