Can a soldier be executed for killing fellow soldiers? It is the state of Texas and I think Texas is a huge death penalty state. What happens in this kind of case where he is a soldier?

Yes, Texas is a death penalty state - I'm a Native Texan. But I don't think it matters in this case - this was on Federal Property, not state property. If the shooter survives, he will be tried in a military court. The state's policy on death penalty doesn't matter here, IMHO.

He will be brough up on an Article 118 according to the UCMJ. The mandatory minimum is life imprisonment with a possibility of parole. The maximum is death.

Dick Cheney constantly reminded everyone there was not a single terrorist attack on US soil and his approval of torture resulted in no attack on US soil. How dare Dick Cheney can say that. And Dick Cheney constantly belittled Obama is unpatriotic. I hope this will change Dick Cheney's view on torture !

How will this change his view on torture?

The Major was not tortured at any point in his career.

My though is that he heard the horror stories from the soldiers that came back and just does not want to experence it.

Guess what, no one in ANY of the armed forces WANTS to go to war. It is just a occupation hazzard. It's always there in the back of your mind that your going to, at some point, be deployed. There is nothing you can do about it, there is nothing you can do to get out of it.

Also what does your post hve to do with the OP asking if he can be executed?

the wikipedia entry on him says that he was harassed by fellow soldiers for being muslim. maybe this was simply payback.

They are reporting he was transfered from Walter Reade to Fort Hood after he received a bad evaluation report, but yet they had just recently promoted him to Major. And that he was someone who they knew might be a problem from reports of things he had posted on the net and said.

A lot of this just don't make sense IMO.If he was a known problem why just transfer him and schedule him to be sent overseas, which appears to be what set him off.

All day yesterday he was supposedly dead, then the story changes and he's alive. How incompetent are these people?

Think the army got some big time explaining to do on this one.

I think is more along the line of OPSEC and the Army wants to make sure that they get their facts straight. I don't remember hearing anything officaly from the Army about him untill the presser later that evening. But I could be wrong, there were so many conflicting issues going on at that time.

Like today I heard that witness were saying that as he was shooting he was yelling "Allah Akbar" Whether it's true or not we are going to have to wait till we get the Major's side of the story.

Thank God that the Army is pushing hard for Combat Lifesavers, who knows how bad it could have been if not for fellow soldiers helping each other.

The US Army is looking within internally what went wrong !

A special commission should look at why someone can rise through the rank within US Army through ROTC, through Army scholarship at Virginia Tech and then to the Uniformed Medical School and spent 7 years in internship, residency and fellowship at Walter Reed.

But every company should look very hard at itself are they paying lip service to Harmony Team, Ways and Means Committee, Health and Safety Committee and many more.

No employee should "GO POSTAL", there is something a company, an institution like US Army has missed.

Force can not solve all the problems. Firing employees can not solve all the problems.

It will take a hard look at US Army Medical Corps of its brutal racial discrimination tone against their owns !

I hope something is good coming out from this Army Investigation.

The commission is separate from the criminal investigation into the shooting. A formal announcement of the panel is expected in the next several days. The commission's charter - for instance, whether it has subpoena power - is still being worked out, reports Dozier.

Army Chief-of-Staff Gen. George Casey had said previously that the military would have to "look hard internally, hard at ourselves" in assessing how the shooting came to happen.

If Major Nadal has problems, why is he accepted into the Walter Reed Fellowship program and just got promoted to Major in May, 2009 !

The Army missed something BIG !
