Incomplete how? By disregarding the idea that the testing agencies and porn companies are ultimately responsible for what Marcus did? Please don't suggest that Marcus isn't ultimately responsible. They potentially share liability, but that doesn't make them mutually exclusive.
Talking about keeping it real....You KNOW porn companys aren't going to be held liable for purposely ignoring condom laws that exist primarily to protect workers from STD's...Porn companies purposely and knowingly ignore the law and they set the work enviroment and decide who gets work...and testing agencies make allowances as they see fit to protect the intersets of the porn companies...
Marcus is an employee..if his superiors aren't held accountable for their purposeful criminal acts, then why should he ?
Because he choose to engage in behavior that knowingly put other people in harm's way. It's not a matter of relativism, it's a matter of law. I agree that the companies should be held accountable, but that doesn't absolve Marcus from the crimes he committed.
That's the nature of corporation. Limited liability.
Good luck prosecuting it. I get where you're coming from, but it doesn't excuse what Marcus did. He alone is responsible for the situation he's in. I won't take any joy out of seeing the guy get burned, but it's a real possibility that he will. Society isn't fair, but it's a lot less fair if you're stupid.
If the DA ever got interested in it, then prosecution would be open and shut, because porn companies make no secret of the fact that they purposely ignore the condom law meant to help protect workers from STD's...
Marcus can't walk into work at a porn company on Monday morning and say "you know what, I think I want to wear a condom today to protect myself and my co-workers from the possibility of STDs"..lol..they would laugh in his face and send him home without work...
That's why I would say there is about a 98% chance that Marcus won't face any charges, because porn is to lucrative in LA, and if he get's caught up in a case and starts running his mouth, then the whole industry stands to loose out big time...
Because basically his position would be that if I'm going down for this ****, i'm taking all you MF's with me !!
I think eric is just being contrary for the sake of it.
I do not believe for a second that you, "eric" are in the industry. There has been no proof of that while you have been asking Mariah for proof of her cooking show being aired.
Mr Marcus is liable to prosecution for what he has done - ie knowingly infect others with an infectious disease. Whether or not he is charged is up to the legal authorities, but he can be charged under the law.
Fair points, but he's still responsible for the choices he makes. Regardless of whether or not he's prosecuted he's still demonstrated that he's a lowlife with no regard for the people he works with. You're ok with it because you weren't affected by it, but if you were one the people he infected you would be singing a different tune.
No offense to you my friend, but who cares what you think about my industry status...
now as far as the issue at hand...
Any action by the DA would be brought on behalf of the infected individuals in which case a porn company purposely ********* condom laws would be as great a contributing factor to infection as what Marcus did...The whole purpose of the law is to protect against the potential spread of STDs , and besides Marcus had been treated and thought he was cured, so he didn't intently infect anyone...Meanwhile porn companies "purposely" ignore condom laws everyday.
I wouldn't say that I'm ok with it at all...but seriously I know alot of porn folks that get STD's...99% of the time you don't hear about it...but if it's treatable its not the end of the world...so after 18 yrs in the industry do i think he should be black-listed or prosecuted for one error in judgement... no...I'm sure you would want the same compassion if you fucked up one time after 18 years on your job.
Prison is full of people who only fucked up once. More often, it's a matter of only being caught once. Whatever happens to Marcus, I hope he learns from the situation and applies those lessons to life.
