Police Officer Unhappy With Breathalyzer Result - Goes for FORCED Urine Sample

LAWRENCEBURG, Ind. -- An Indiana man has filed a lawsuit claiming that police forcibly withdrew blood and urine from his body during a drunken driving arrest, WLWT-TV reported.

According to the suit, police arrested Jamie Lockard, 53, on suspicion of drunken driving in March.

A Breathalyzer test showed he was under the legal limit, but Officer Brian Miller doubted the findings.

Lockard and his attorney claim in the suit that police took him to Dearborn County Hospital and forced him to submit to a urine and blood test.

Police said they obtained a warrant, but Lockard's attorney said his client was shackled to a gurney and had a catheter inserted against his will.

WTF...if they established that breathilizers are what should be used to test for dd, how did they get the warrant to force piss and blood??? He must have been offering it freely when he realized what they were about to do...

Even without a warrant, he would have done it. He wanted a result, and did what he felt like doing to get it. He would have probably claimed terrorism, and sited the Patriot act, to get what he wants. Typical example of a cop getting over zealous, and thinking he has to win.
 
Once the cop had the breathalyzer result that said the fellow was within the legal limit, and thus okay as far as alcohol went, he should have just let it go. If the guy was driving recklessly, which made the cop suspicious, he could've busted him for reckless driving.

I think this cop just got desperate and didn't want to admit that his hunch was wrong...

Well laws differ in many jurisdictions as to law enforcement's ability to compel you to give samples. However, merely being under the limit for blood alcohol doesn't mean you're not under the influence of some other drug. Which would be the reasoning behind testing urine or blood.

That said, the cop still deserves to get fisted by Mike Tyson for this.
 
Was this a mobile breathalyzer test? Usually they aren't 100% accurate and if there is doubt they should have a more accurate reading from the breathalyzer machine held at the Police station. I know that is the protocol in the UK.

It is also in UK Police Powers at a police station that if a sample is refused from the arrested party that force can be used to obtain a sample but only by a certified doctor, i doubt with the force applied in this case either.

Just another power trip giving the rest of the police force a bad name.
