Measure B Election Results: Porn's Mandatory Condom Initiative Wins; Industry Vows Challenge*

Updated with the initiative winning. The industry says it will challenge the measure in court. First posted at 9:38 p.m. Tuesday.

Despite disapproval from the porn industry, the Los Angeles Times and the L.A. Daily News, the L.A. county initiative that would mandate condoms in porn was winning tonight.

According to early L.A. County Registrar-Recorder figures measure B was winning 63 percent in favor to 36 percent against.

Measure B was spearheaded by the AIDS Healthcare Foundation which has, for years, tried to get the adult business to play safe.

The organization cites California workplace safety officials who say condoms are indeed the law in the state; they just don't have the resources to enforce the rule.

The initiative, then, sought to institutionalize condoms through massage-parlor-like permitting for adult production throughout most of the county (Pasadena, Long Beach and Vernon, which have their own health departments, are exempt).

The city of Los Angeles has a similar rule -- for on-location shoots that properly seek permits -- but has yet to figure out how to enforce it.

The industry has argued that consumers won't buy condom porn and that enforcement would push the multi-billion-dollar business underground and out of Los Angeles' "Porn Valley."

AIDS Healthcare has cited a 2004 HIV scare and summer's syphilis scare as evidence that the industry's monthly STD testing protocol for performers doesn't work.

The most successful argument against measure B seems to be the one that claims it would empower bigger government without the means for enforcement.

But AHF says it's about more than that: It's about human life.

[Update at 11:58 p.m.]: The initiative continued to win tonight with 33 percent of precincts reporting. Voting was about 60 percent in favor and 39 percent opposed.

Political consultant James Lee of the No on Measure B campaign told the Weekly there was still hope however, especially considering the slow pace of the L.A. county count. He indicated many votes in whiter, more liberal parts of L.A., including the Westside, had yet to be tallied and could end up favoring the no side.

[Update at 12:47 p.m. Wednesday]: It won 55 percent to 45 percent. Actually it was closer (55.85 percent) to 56. While the AIDS Healthcare Foundation held a news conference this afternoon to celebrate, the industry lobbying group known as the Free Speech Coalition said it would challenge the measure in court.

Diane Duke, CEO of the FSC:
We believe in the calm, serious deliberations of the legal system we will find that Measure B is in fact unconstitutional.

The industry sent a letter to the L.A. County Board of Supervisors indicating its threat. In it, Duke says:
We believe that the law is not only unconstitutional on the grounds of forced expression, but also falls within the jurisdiction of the state of California rather than local government. Therefore, we will file suit and challenge this intolerable law in court.

It's was NOT a statewide vote! Measure B is ONLY Los Angeles County! Most of the industry is within an hours drive of four Counties that would probably welcome their business. Then there's the legal challenge, I think there's about 75% chance it will lose in the courts.

that sucks anyway... I agree the government concerns 'bout the sexually transmissive diseases but they have to trust the porn industry which has complete no interrest to play with.
brazzers recently had issues with syphilis and their bizness was broke down for weeks (quarantine)... each porn director must take care of what he/she uses to earn money that's logic.

the youth must have a sexual education in school concerning the use of condoms... young adults of 18 or 21 must know that unprotected sex may rise the risks to get std'z... but let us enjoy porn without plastic by god sake !

That's pretty easy. Pay someone to sit at a desk with a pack of rubbers. Wait for some dumb schmuck to ask the county clerk for a permit. If someone ever does ask for a permit then the meat wrapper goes on location. I love the California mentality.

IF the measure is left to stand, other counties/states will be able to adopt it more successfully because Measure B in LA county will have set a precedence.

But as someone who was 12 hours away from getting my leg amputated and 18-24 hours away from dying, nothing is more important than your health. Porno flicks ain't worth life altering and/or life threatening diseases.

yes there is a point to care. If it passes in one county it is easier and more likely to pass in other counties/states or even nation wide.

The thing is, this measure isn't about condoms and dental dams. If you read the language of the measure, it's going to require the actors to take the same precautions against body fluids as a hospital. So that means condoms and dentaldams ontop of lab jacket, goggles (though evidently they dropped that from the measure), gloves, hair nets, and so on.

Unless you have some sort of medical fetish....I'm not entirely sure you want that in your porn.

More STDs Among Porn Stars Than Prostitutes

(Newser) – Who is more likely to have an STD: a Los Angeles porn star or a Nevada prostitute? According to a new study, the former, by far. A survey of 168 LA County adult film stars found 28% have gonorrhea, chlamydia, or both; the number of prostitutes infected is negligible, the Los Angeles Times reports. That's because Nevada state law requires them to use condoms, and they're tested every week for the diseases, notes the report, which comes ahead of an LA County ballot measure that would force actors to use condoms on set.

Since Nevada instituted the condom and STD testing rules, there have been no cases of HIV infection among prostitutes, adds the report, whereas the porn industry has seen several. What's more, "the report clearly shows that current testing practices miss two-thirds of active gonorrhea and chlamydia infections" among porn stars, says an expert. The porn industry counters that regular urine testing of performers makes for a safe environment, but the LAT notes that actors aren't checked for rectal or oral infections.
