This initiative tries to forbid filming porn movies without the use of condoms.

There are some very good reasons why this is primarily not a good idea, and then - the real reasosn are rather clear: Try to defeat the porn industry.

TOO LATE- I just mailed the ballot an hour ago

when your in the country illegally you have to vote by early mail in - so you can skirt the law.

I pay taxes too

The Porn Industry is going to have to move toward forming independent private clubs for their filming and independent contractors to circumvent this nonsense. There are plenty of creative lawyers ready to work around this if it passes.

All is not lost.

Just about every Calif newspaper and political figure has come out against 60 so I don't think it will pass. If it does then the courts will have many Constitutional issues to throw it out.

We are talking trade practices and regulation of an industry.

How exactly is this a Constitutional issue?

Haven't you ever heard of the 35th Amendment? It's the right to splooge unfettered. I might be on cough medicine right now.

Due to previous attempts to outlaw porn that got to the Supreme Court and the porn industry won on First Amendment grounds. Now the industry is one of the few that actually has a guaranteed right to exist and express themselves as they choice.

So if the law passes;
and you have a married couple whose web site is a web cam of them having sex before bed five nights a week, and they are trying to have children. How dare the state (or any viewer per prop 60) tell them they must wear a condom?

Another situation: a story that has a secretary having sex with several of her bosses and becomes pregnant and in flashbacks tries to figure out which one might be the Father. A condom law would interfere with artistic expression and it might be a "use a condom morale"!

Vote against it if you're in CA!

I did today, three long pages of the ballot 5 sides. Besides the elected offices, 17 statewide propositions, 2 county and a couple local ones. On Tuesday the San Jose Mercury News published their annual Voter guide to the Props with Who (biggest donors) spent How much on What. Prop 60 $4.6mil For mostly AHF, $452k against mostly Wicked, Stagliano. Prop56 Tobacco Co spent $66mil to fight cigarette tax. Prop61 BigPharm spending $109mil to fight drug price control.

To be honest, of all of the political issues I'd be concerned with if I lived in California, this one would be WAY down on the list... like last. From general observation, most of the formulaic, assembly line crap porn that gets produced these days rolls out of the big California houses. Who cares where it's produced? If this prop passes, the Cali producers can either shut down, use condoms or start filming in other places, like Arizona. FTV Rob (Robert Simyar) has made a mint being based in and shooting most of his content in Arizona. It's the digital/internet age. No one cares where a scene is shot, apart from not seeing a Malibu Beach house in a scene for the 5000th time. A lot of the pro/am sites are now based in Arizona and Florida.

IMO, what's going on with this proposition is just indicative of a larger issue in California: over-regulation by an out of control, nanny state government. Seems like the dog is beginning to eat its tail.
