This is conjecture. Now if anyone has seen the video it would be someone in the Los Angeles District attorney's office. But they can't press charges against Markus Dupree or anyone involved in the making of the movie. August Ames signed the documents after the filming was finished saying that everything was fine and that nothing bad happened while filming that scene.
To tie her tweets into the matter, after the fact, is hearsay evidence. The DA's office has them too. However, the prosecutor would have no case to stand on. The judge would throw it all out.
