A Legal Question

maybe, but we can also give you a 'hypothetical' beat down.

Hypothetically speaking...

Let's say that I troll this message boards. I get banned. Then I create new user-name and get banned again for trolling. This happens multiple times.

Can Freeones complain to my ISP and take legal action against me?

It's email address recognition last I checked (but not for events such as becoming a hypothetical arse ho)

If this is a legal query, keep in mind one thing - Anything can happen ! It all depends on how far each, individual party wishes to pursue said endeavors. CYA bro ! CYA !

It would be a lot of work for them. It would be more or less difficult depending on where the you are, but if they really wanted to yes they could probably take legal action and eventually force your ISP to provide them with the identity of the person that owns the account and then go from there.

Depending on the ISP they might just be willing to step in themselves even before it had to get to that if it felt one of it's customers was doing something wrong and violated it's user agreements.

^ what if the user was on wireless internet. That's why i think they track you by i.p. addresses :dunno:

Legal action based on what? What laws would you have broken? Sure, your ISP may cave simply because they don't want to bother with telling Freeones they don't want to give the IP away, but even then, I'd love to know what legal avenue Freeones could pursue. The closest angle I can think of is trespassing, but I don't know of trespassing ever having been a legal claim in the online world. But still, the Internet, despite being virtual, is still based on hardware (servers), and for this reason, may hold a viable trespassing claim.

In any event, it's best not to get yourself into murky legal waters, because once you're there, you don't know if the other side will put up a more vigorous legal battle.

Yes, freeones can initiate legal proceedings.

Abuse. Harassment. Trespassing.

For starters.

The internet isn't actually as "anonymous" as most people think - it never truly was.

Wireless has absolutely no bearing on your...
::tries to find a word that means anonymity but.. simpler::
on your.. whatever. It just doesnt.

wireless or wired: makes no difference: there is NO anonymity on the Internet. IP addresses are logged, IP traffic is logged, email is logged; ergo, downloads and torrents are logged, participation in newsgroups is logged etc. :)

I would say so but don't do nothing to get banned and you don't have to worry about this.

harrassment, maybe. trespassing? I don't think so. the internet is public domain, even a privately owned website (in fact, all websites are privately owned.) It's essentially the same logic as trying to claim property rights (real ones, not "intellectual", that only applies if you are the RIAA, apparently) on your telephone number.

I don't think there's really much chance for breaking laws in that scenario...But they could have a good chance taking the user to civil court. After all, this is America baby! You can sue anyone for anything.

...and don't think proxy servers and/or 'anonymous' web browsers will help you - they won't:2 cents:

If you do it please come back once more to let us know how it went. lol I'm sure everyone has always wanted to know the answer to that one. NOT! Why not just pretend you're a grownup, blend in and have fun? ;)

Honestly, I don't see why anyone would want too. In my way of thinking if you can't handle the board like an adult go to Nickelodeon. If you have "I'm a hater" issues there are many great flame boards out there go join them and leave others alone.

I do know this, they can contact your server, then you (or whoever's name its in) and your server will disconnect you and your address and then blackball your address to others. I'm not sure if they would bother to take you to court.

I am not familiar with abuse being being a cause for legal action. Maybe you mean battery? Harassment, if I am not mistaken, can only be done against a person, not a machine (server) or company. Trespassing, while it probably has never been used as a claim, may work.

Freeones doesn't have to resort to legal matters.

Not when they can send the girls round to see you..

Indeed, there's no anonymity here ! Last year, an Administrator of an outdoor / sporting type of sight posted that "John Smith" got popped for his posting . . . in such a braggadcocious fashion, that he and his huntin' buddies bagged an illegality during their hunt. To boot, he'd posted a pic of the evidence !
Via a govt. agency that will remain nameless, said "Mr. Smith" was popped for his infidelity with local laws pertaining to his area on the map. ~
