I can't speak to the PS3 specifically, but I can tell you I bought the retail disk, and no, you do not need GTA IV to play the expansion. As far as downloading it, it looks like you do need the disc to play. But if you buy the retail version, you're fine without it.

Servers, (the computers which host websites) can only service so many different people at a time. If the number of users grows, typically at some point so too do the number of servers. Getting that message is essentially Freeones saying there are too many people on the board at one time.
