My guess is, the rubber band is there so that he doesn't actually have to wear the seatbelt, but it gives the appearance of it. He probably has to be in that thing all day, as it looks like he's driving a tour bus (hence the microphone), and so wearing the seatbelt would be a pain in the ass.
