South Africa has signed and ratified the treaty for ICC, so Omar al-Bashir will probably be going to the Hague.

It is unlikely that South Africa will face sanctions for allowing Mr Bashir to leave the country even after a court order barred him from doing so, says the BBC's Nomsa Maseko in Pretoria.
A number of African countries have in the past decided not to co-operate with the ICC. The court has been accused of racism and bias against African leaders.

With a rich history of dictators, oppression, wars, warlords, corruption and genocide it's not surprising the ICC has an eye on Africa. Not really biased me thinks. And by shamelessly letting this man go they're not proving to be trustworthy either. Shame.
