Man arrested for FINDING gun in his backyard

Something has got to be missing from this story???

That's what puzzles me.The Crown prosecution Service vets all prosecutions for a) whether the case has a reasonable chance of securing a guilty verdict and b) whether the case is in the public interest.

At face value the case fails on point b.What would be the point expending time and money (when the court system is creaking with overwork) to prosecute somebody who had no criminal intent and thought he was doing his public duty? Particularly as handing in the weapon WAS in the public interest.
 
I don't know all the facts of the case, but I will play devil's advocate.

The implication in the story is that when he rang the Chief Superintendent, he told them what he was going to do. He didn't. If he had they would have told him to leave the gun alone, granted him a temporary license and sent someone to retrieve it. Also remember, British police, especially in places like Surrey, don't see a lot of guns. So from their perspective, a man walked into a police station with a gun.
 
This reminds me of the incident where a guy found 8 grand in a carrier bag and handed it into the police. They treated him as if he was a criminal, they interogated him and then charged him. And all the man did was be honest and hand in what he found. It doesn't pay to be too honest in todays way of life. If I saw a bag of money I'd fucking keep it. I'd hold onto it for about six months then spend it. The fucking fascist bastards never gave him a chance, even though he had no criminal record or links to criminals.

There is another situation in London recently where a guy found a loaded revolver and a bag of money in a school playground. He called The Fascists and they told him no one could come to collect the stuff, he would have to bring it to them instead. What a load of crap!. The reason these fat bastard police men wouldn't have been able to come and collect the money and gun from him would be because they are too fucking DUMB to find their way out of the building they were in.

That's exactly the problem....over there "guns" are apparently seen as a dangerous animal where you have to call animal control to capture them.

So much so that in a case where an individual obviously has no malicious intent in handling the thing...he is punished for the mere fact that he handled it.

That's idiocy IMO.

I don't think it was reasonable of the jury to find Mr. Clarke guilty for turning in the weapon the way that he did, but he should have been a little smarter about the situation. He definitely should have just called the police and had an officer take care of it. Just another example of how the justice system is far from perfect.
He should have kept his big mouth shut, thata way he would have a handy blaster for when the islama-shit-hits the fan day comes.... till then, he's reduced to a butter knife if those are still legal by the time he gets out of jail. :D :pimpdaddy:

Sounds like I thought, all prima facie since the guy wasn't exactly a model citizen. Because he wasn't a model citizen it appears they followed the letter of the law with him.

The simple fact that the letter of the law could have someone arrested and convicted for the act of turning in a firearm means the letter of the law is idiotic.

It's already happened to us Yanks. Remember the guy who was convicted of illegally transferring a "machine gun" after he lent his buddy his SEMI-AUTOMATIC AR15?

And there's lots of cases like the one you mentioned. Somebody drives to the PD to surrender their abusive husband or thug son's gun and they face charges. I keep waiting for somebody to get arrested during one of those gift cards for illegal gun drives. Somebody will get pulled over on their way to drop off some old shitty Lorcin or something and next thing you know, he's getting 18 months.

Never trust the po-lice.
