Yes the law is the law, and if she was 17 in the pics, then...well she is 17. But everyone KNOWS this isn't child porn. Textbook/legally maybe, sure. he doesn't deserve jail time. He made a poor judgement call, and posted something that he likely didn't even remember was underage. He's not making, selling, trading or bating to children...he posted something he deemed "newsworthy" that involved an almost-18yr old. Illegal technically-yes. Jailworthy? Hell no. Especially since the "minor" in question has done implied nudity since she was 15- at the consent of her parents. THEY should be the ones going to jail, not Perez!
