New Gloryhole Swallow Name

we got a letter last month from Larry Flynt's attorney letting us know that they are legally taking the domain name "Gloryhole Hustlers" because apparently if you're in the adult biz no one can use the dictionary word "Hustler". we talked to quite a few trademark lawyers and they all said not to fight it because he will sue us in district court and it could cost between $100K-$400K. that might be pocket change for Larry but not us so we decided to change the name to " Premium Link Upgrade ". crazy huh?

has anyone ever heard anything like this before?

i personally don't think anyone should be able to trademark words like that but that's how it is. why didn't someone trademark words like "cum"? that's a made up word.

the only reason it's an issue is because we both make adult videos. we used it in a completely different context. it's not like we used Hustler Gloryhole.

why not use "Gloryhole Suckers"? Flynt is just protecting his trademark Chica. If he allows you to use the term "Hustler", someone else might take advantage and use it in a form more damaging to Flynt's trademark.

see, that's the thing. you can use the domain "Hustler Sucks" and that's ok because it's freedom of speech. you just can't profit from that name. i somewhat understand their point because we're both in the adult biz and apparently Hustler made a gloryhole video before. Larry isn't one to talk considering some of the messed up things he's done like that domain with Glen Beck. he did that just to mess with him, no other reason.

it's not a big deal because we already had a contest in the member's area to let them pick the new name, i just thought it was funny.

I agree with Hustler in this case. Regardless of your actual intentions, it would appear to a casual observer that you're affiliated in some way with the Hustler brand name. That brand was established long before you were. They've also been very successful in the adult industry, the same industry your website is affiliated with. That's why they get to cry foul when someone else uses the name Hustler in regards to porn or related enterprises. It's like Rolls Royce going after every single goddamn company that uses that name (i.e. - we're the Rolls Royce of the plumbing business). Names are big money these days. And if Hustler isn't getting a cut of something with their name in it, they have a right to protect it. I'm not saying that I agree with any of this bullshit, but I can see where they're coming from.

The idea behind such legal actions is understandable depending on the situation, but in this case it is kinda dumb. "Hustle" is a word, and you used "Hustlers", not "Hustler." Honestly, I think even "Hustler" should be usable provided it's differentiated in a significant way. "Gloryhole Hustler" should even be fine. Now "Gloryholes by Hustler" or "Hustler's Gloryholes" or something should understandably be off limits because it indicates association, but it's dumb that someone can own a common word. The brand shouldn't just be the name. It's the logo, color schemes, typefaces, etc. If you want to own the words in a brand name outright you should have to make it up yourself (Rolls Royce, Microsoft).

it's a stretch but i think Larry lives for this kind of stuff and would be willing to go all the way until he got the name so we decided it's best just to move on with a new name and spend our time making new content

besides, making videos is a lot more fun than being in court!
